Adoption Fee: $_________ Shipping: $_________ Total: $__________ Adopter: _________________________________________________________________ Address: _______________________________________ _________________________________________ Telephone: _____________________________ E-Mail: _________________________________ CONDITIONS OF PLACEMENT OF CAT/KITTEN: Adopter accepts full responsibility for the care of this cat/kitten and agrees to the following terms: Pet cats/kittens will NOT be sold or given away to anyone, for any reason, without the Breeder's prior WRITTEN consent. NO EXCEPTIONS! Adopter agrees that this cat/kitten will NEVER be bred and also agrees to spay or neuter this cat/kitten within 6 months from the date of delivery. If the Breeder does not receive verification of altering from a certified veterinarian within this period, an additional penalty payment of $625 for not adhering to this contract shall be immediately due and payable to the Breeder. In such case, CFA registration papers WILL NOT be provided to the Adopter at any time due to breach of contract, as this cat/kitten is being placed strictly as a PET ONLY. If this cat/kitten is EVER to be bred or sire a litter, whether by accident or not, and/or prior to the spay/neuter date, ALL kittens produced in all litters are the property of the Breeder, and ANY monies paid and/or items received by the Adopter for the sale of said kittens, shall be rendered immediately to the Breeder. The Breeder agrees to deliver the cat/kitten's CFA registration papers to the Adopter within 30 days of receiving a valid notification of altering from the Adopter, provided by a licensed veterinarian. Breeder reserves the right to contact said veterinarian at any time. This cat/kitten will NEVER be allowed to roam freely outdoors. Adopter agrees to maintain proper veterinary care for the cat/kitten, including all yearly check-ups and vaccinations. I strongly recommend that this cat/kitten NOT be declawed, as this is mutilation and an inhumane procedure. Declawing is surgically removing the tips of the fingers, and I am certain my kittens enjoy their fingers and toes intact. This cat/kitten must NEVER be given or sold to any research or testing facility, pet shop or like organization. If the Adopter is no longer able to be responsible for the cat/kitten, it is required that the Adopter contacts the Breeder immediately and in some cases, the Breeder will allow the return of the cat/kitten. This decision is based solely on the Breeder's discretion. Furthermore, the Breeder would always be willing to assist in finding a new home for the cat/kitten. In the event the Breeder agrees to the return of the cat/kitten, immediately prior to its return to the Breeder, it MUST first be examined by a licensed veterinarian, have a FELV/FIV test ran with negative results, a fecal examination done with no parasites of any kind found, a flea treatment such as Revolution administered, a complete blood panel done, examined thoroughly for ringworm with cultures taken if needed and found to be completely ringworm-free, as well as have a health certificate issued for said cat/kitten. All medical records, CFA registration papers (transferring ownership back to the Breeder), documents given to Adopter by Breeder, MUST be returned with the cat/kitten. All tests and veterinary expenses to return said cat/kitten are the responsibility of the Adopter. The Breeder assumes no responsibility of any veterinary costs in the possibility of a cat/kitten being returned. Furthermore, any and all shipping/delivery expenses are the sole responsibility of the Adopter. The results of the above mentioned testing must be provided to the Breeder by the licensed veterinarian who performed the tests prior to any final decisions being made. NO REFUND OR COMPENSATION OF ANY KIND WILL BE MADE TO THE ADOPTER. HEALTH AND GENETIC DEFECT GUARANTEE: Breeder guarantees that this cat/kitten is in good health at the time of delivery. Adopter MUST have the cat/kitten examined by a licensed veterinarian within 72 hours from the date of delivery or pick-up, and a copy of the receipt of this examination MUST be sent to the Breeder. It is highly advised to keep this cat/kitten secluded and away from all other animals until it is examined. Should the cat/kitten be found to be of ill health, Adopter may return the cat/kitten within 72 hours for a full refund of the adoption fee. Failure to have the cat/kitten examined by a licensed veterinarian, within the 72 hour time frame, will negate this health guarantee and render this contract void. Any and all vet bills or debts incurred on behalf of this cat/kitten, including shipping/delivery, are the sole responsibility of the Adopter. NO REFUNDS WILL BE MADE AFTER 72 HOURS. Breeder does not guarantee against fleas, fungus, or mites as these are very treatable and so common in Persians that the Breeder feels unable to guarantee against them; however, I will never knowingly place any cat or kitten with fleas, fungus or mites. Breeder also believes this cat/kitten to be genetically sound and will be replaced with another cat/kitten, if the cat/kitten was examined by a licensed veterinarian within 72 hours of the date of delivery, and a receipt of this examination was sent to the Breeder, should it die of a genetic defect within one year from date of delivery. Said genetic defect MUST be evident in a necropsy provided by the Adopter. Breeder guarantees this cat/kitten to be PKD (Polycystic Kidney Disease) Negative. ALL of Paws and Purrs Cattery's breeders have been DNA tested for PKD and are N/N (negative); therefore, ALL kittens produced at Paws and Purrs Cattery will also be PKD Negative. Copies of this kitten's Sire and Dam's PKD Results Report will be provided for the Adopter. All cats have been tested or are from negative tested parents within Paws and Purrs Cattery and were found to be negative for Feline Leukemia Virus (FeLV) and Feline Immunodeficiency Virus (FIV). Therefore, all kittens produced are guaranteed to be FeLV/FIV negative at the time of delivery, pick-up or shipping. However, Feline Infectious Peritonitis (FIP) and/or exposure to Feline Enteric Coronavirus (FECV) CANNOT be guaranteed against due to the inaccuracy of currently available tests. Administration of the FELV, FIV and/or FIP vaccinations will immediately render this contract and any guarantees or claims against Breeder, void. There are too many adverse reactions to these vaccinations, as well as 'unknowns', and the Breeder WILL NOT guarantee the health of this cat/kitten if any or all of these vaccinations are administered at any time, for any reason. Breeder reserves the right to cancel this contract, and/or refuse placement of said cat/kitten at any time, for any reason. In this case, the deposit will be refunded along with all other monies received towards the adoption fee due on the cat/kitten. Any cat/kitten not picked up or delivered within 7 days of the agreed upon time, without prior notice and approval by the Breeder, will be forfeited (no reimbursements made), and the Breeder is permitted to place said cat/kitten with another family. In the event of a breach of contract by the Adopter, including but not limited to breeding of said cat/kitten, Adopter will be liable to the Breeder for all legal fees and all costs related to enforcing this contract in the State of Ohio. If the Adopter violates this contract in any way, at any time, a $625 penalty will be assessed immediately for breach of contract, rendering this contract void. The penalty payment for breach of contract is due immediately, payable to the Breeder. NO REFUND OR COMPENSATION OF ANY KIND WILL BE MADE TO THE ADOPTER. The parties hereby agree that the Laws of the State of Ohio shall govern this contract. Any and all claims and/or disputes shall be exclusively venued and brought in the Superior Court of Ohio, Summit County. Adopter hereby agrees to the jurisdiction of the Summit County Superior Court and the choice of Ohio Law and waives any and all defenses to the same regardless of place of domicile. Adopter further agrees to accept the service of process by mail. By signing below, the Adopter is stating that he or she has read, understands and agrees with the terms and conditions within this contract. The Adopter also understands that a minimum $225 deposit is required to hold any cat/kitten and is non-refundable should he/she decide, at any time, not to adopt the cat/kitten. This deposit amount will immediately be deducted from the adoption fee due.
